Aisha Malik, consumer news reporter at TechCrunch, has become a prominent voice throughout the ongoing legal fight against trademark infringement. The fight is centered around student social media startup Fizz. The lawsuit has Fizz pitted against both Instacart and Partyful in the race to launch a new app — called Fizz. Malik came aboard TechCrunch in 2021. Today, she’s using her platform to provide deep dives into this crucial case that’s redefining brand identity and consumer trust.

In support of its claims in the lawsuit, Fizz argues Instacart was acting in bad faith when it registered the domain name <FIZZ.COM>. Additionally, as a second cause of action, the Plaintiff alleges that the Defendant, Instacart, acted in bad faith. Specifically, they claim that Instacart was trying to monetize the FIZZ Marks when it registered the domain name <FIZZ.COM>. This claim is further proof that Instacart’s encroachment can erode the brand goodwill Fizz has built up over the years with its users.
Furthermore, the lawsuit asserts that the new app from Instacart and Partiful represents a direct threat to Fizz’s established identity. According to the complaint, Instacart and Partiful’s new Fizz App “consciously and deliberately seeks to piggyback on the goodwill that the Plaintiff has established with the FIZZ Marks.” It especially focuses on the Plaintiff’s outreach to the Gen-Z demographic.
